07:59 AM EDT, 10/31/2017 (MT Newswires) -- BHP Billiton (BHP) said Tuesday a Brazil court has approved the extension of the date for negotiation of the settlement arrangements related to the Samarco dam failure to Nov. 16.
The court also approved an amendment to the preliminary agreement, which the company and partner Vale SA (VALE) reached with the Federal Prosecutors' Office in Brazil in January, to agree on socioeconomic experts to advise the prosecutors.
BHP said the extension allows for the continuation of the interim security arrangements provided to the court on Jan. 24, and for the continued suspension of the legal proceedings and injunctions.
The preliminary agreement had outlined the process and timeline for the negotiation of a settlement of the BRL155 billion ($48.6 billion) and BRL20 billion public civil claims relating to the dam failure. The agreement suspends a BRL1.2 billion injunction order under the BRL20 billion public civil claim and requests suspension of that claim, with a decision on suspension from the court pending. The court previously suspended the BRL155 billion public civil claim, including the BRL7.7 billion injunction request.
